INFORMATION PAPER IMPC-HAW-HRM 1 October 2012 SUBJECT: Deletion and Deferment 1. Purpose. To provide information and procedures for processing Deletion or Deferment requests. 2. Reference. a. AR 600-8-11 - Chapter 2-15, section 7 through 16 and MILPER Message Number 11-115 b. AR 614-5 and AR 614-200 3. Processing requirements. The processing time to request deletion or deferment requires a minimum of two weeks for a Human Resources Command (HRC) response. 4. Reason for Deletion/Deferment: Examples of reasons for deletions or deferment are: Completion of Declination of Continued Service Statement (DCSS), Execution of Foreign Service Tour Extension (FSTE); Pregnancy; Flagging action and Retirement. 5. Deciding on Deletion or Deferment. a. Request for deferment if the situation can be remedied within 120 days of the report date. b. Request for a deletion if the situation cannot be resolved within 120 days of the report date. 6. DHR Responsibilities: On receipt of Assignment Instructions (AI) from HRC, the losing installation or activity commander will ensure that each Soldier is eligible for assignment. Each Soldier must meet the eligibility requirements listed below, as applicable: a. Be eligible for reassignment IAW AR 614-200, Enlisted Assignments and Utilization Management. b. Be eligible for OCONUS service IAW AR 614-30, Overseas Service. c. Be physically qualified for duties associated with the MOS, assignment, and geographic area IAW AR 600-60, Physical Performance Evaluation System. d. Be eligible IAW AR 600-20, Army Command Policy. IMPC-HAW-HRM SUBJECT: Deletion and Deferment e. Meet the security investigation requirements specified in the AI. If necessary, the required security investigation will be initiated promptly. Soldiers will not be held at the home station pending results of the investigation unless such guidance is annotated in the Special Instructions (SI) of the assignment. The losing command will initiate deletion or deferment action if the United States Army Central Personnel Security Clearance Facility cannot issue the required security clearance or furnishes information that causes the Soldier to be disqualified by the losing unit commander for a Personnel Reliability Program (see AR 50-5) or Chemical Personnel Reliability Program (see AR 50-6) assignment. In all cases, results of the investigation will be sent to the gaining command. 7. Compassionate Deletion/Deferment: Defined as a request based on compassionate reasons or extreme family problems. 8. Procedures for Compassionate Deletion. a. Requests based on compassionate reasons or extreme family problems (reason codes EF and CG) will be submitted in hard copy to HRC, AHRC-EPO-A. b. Deferment should be used instead of deletions if the extreme family problems can be resolved within 90 days of the report month. c. Request will be submitted to arrive at HRC within 30 days of EDAS cycle date. If deletion/deferment situation occurs after the initial 30 days, request will be submitted within 72 hours after situation occurs (or becomes known to Soldier). d. If request is based on medical problems of a Family Member, a signed statement from the attending physician giving specific medical diagnosis and prognosis of illness (including date of onset, periods of hospitalization and convalescence) must be included. If illness is terminal, life expectancy must be included. Medical statement will list any factors that establish that the Soldier’s presence will have a bearing on the medical condition. e. If request is based upon legal problems, it must include a signed statement from licensed attorney stating problems and reasons why Soldier’s presence is essential. f. If request is based upon other than medical or legal problems, supporting statements from responsible persons (such as clergy, social workers, etc. who have personal knowledge of the problem) must be included. IMPC-HAW-HRM SUBJECT: Deletion and Deferment g. Deletion code HA may only be requested with General Court Martial Convening Authority (GCMCA) approval and documentation. This code is for deletions based on recent death of a Soldier’s spouse or child, or for recent documented rape of a Soldier’s spouse or child (within previous 9 months of Soldier’s report date). h. Deferment code HB may only be requested with (GCMCA) approval and documentation. This code is used for 60 day deferments for Soldiers enrolling in the Exceptional Family Member Program (EFMP) who are still waiting on an EFMP Family travel decision. Deferments for more than 60 days based on EFMP Family travel will be sent to HRC, AHRC-EPO-A for action. 9. DHR Local Procedures for Deletion/Deferment. a. Request for deletion/deferment is initiated by a DA Form 4187 along with supporting documentation to the S1. If commander recommends approval the DA Form 4187 is then forwarded to the Brigade Commander (06) and to the MPD Reassignment Section for Non-PSDR units only. PSDR units will forward requests thru USARPAC to HRC. b. Operational deletions for all units will be submitted as FSTE thru their respective G1’s to HRC. c. Soldiers requiring a deferment should submit DA form 4187 with supporting documents: (1) DA Form 4187 should state the following: (a) The reason for deferment. (I.e.: Pregnancy, doctor’s letter, FSTE etc.) (b) Current Availability date (c) Current Reporting date. (d) Requested Avail and Report date. d. Soldiers submitting a deletion are required to submit a DA form 4187 and supporting documents. Deletion or deferment requests will include all relevant supporting documentation or justification which will be maintained for 90 days following the approval/validation of request. DA Form 4187 should include supporting documentation (For example: Deletion due to medical needs a medical to have a medical profile and letter stating why the Soldier cannot comply with Permanent Change of Station (PCS) instructions. 10. MPD submits the request through Enlisted Distribution Assignment System (EDAS). 11. More than one deletion or deferment request may be submitted on a Soldier, if the condition(s) supporting the request are not related. 12. Requests for multiple deferments or early arrival will not exceed a total of 120 days before or after the requirement month (RQRRD) to the gaining command, unless exception to policy is approved by HRC (AHRC-EPO-P). 13. Reassignment processing will continue until the deletion or deferment is confirmed through EDAS or in writing. Soldiers should continue all other out-processing while pending a decision on their request. 14. If a request is disapproved, Soldiers will comply with the original report date.
